Not Really, taken from page 226 from the PDF you can find there without registering (annoying behaviour anyway) :

Kontender ES© is a commercial product

Makes the biggest difference with SME I think.

SME server is also a commercial product.You can legally buy it, and you will obtain a copy of the source code, and the GPL, which will give you the right to resell it, under the same conditions. Contact me, if you wish to buy it and obtain commercial support.

Kontender ES appears to me to be illegally distributed software, including many components, including some SME server software. It appears to be put together and marketed by the same people who cobbled  together "Kuadra Enterprise Server".

I am not a lawyer, and have not seen a copy of Kontender, so I won't/can't comment on the legality of its distribution.  If anyone has a copy and thinks there is a problem, then the right thing to do would be report it to the copyright holders of the software in question.
